Sink Sunk in FL-13

In a stunning final special election result from Florida last night, Republican David Jolly, who opponents painted as a Washington lobbyist representing an organization that favors Social Security privatization, upset favored Democratic candidate Alex Sink in Florida’s 13th Congressional District. The campaign’s conclusion carries national implications.

The Affordable Care Act was front and center throughout the contest, with Jolly touting his opposition to the program and Sink relying on a catch phrase of “keeping what’s right [with the healthcare program] and fixing what’s wrong”. Her argument, before a Sunshine State congressional district with the sixth largest segmentation of people (in Florida) over 65 years of age (22.8 percent), apparently fell upon largely disbelieving ears.

Jolly won the race 48.5 – 46.6 percent, with 4.8 percent going to Libertarian Party nominee Lucas Overby. The Republican victory margin was 3,456 votes from a huge total of 183,627 ballots cast.

Romney’s Debate Win Has Legs

The Gallup organization projects Mitt Romney to be the most decisive debate winner in the history of the presidential debates. According to a cell sample of 749 debate watchers questioned over a two-day period following the Oct. 3 forum, Romney was viewed to have won by a 72-20 percent margin, the largest-ever spread. But, does a debate win really carry over into the presidential campaign itself? At least in the short-term, apparently so. Gallup shows the race closing to 48-46 percent in favor of President Obama from the previous 50-45 percent, and the post-debate track reveals a dead even 47-47 percent result.

The Pew Research Center was also in the field during this same time period (Oct. 4-7), recording the responses of 1,112 likely voters from a polling universe of 1,511 adults. Though a few more Republicans were polled than Democrats (403-396), all the aggregate answers were weighted to bring the sampling universe in line with the actual national totals. The weighted responses gave Romney a similar 66-20 percent split in terms of perceiving the debate winner.

Pew also found Romney gaining in some other key areas. In terms of answering which of the two candidate has new ideas, it is now the Republican who is perceived to have them by a 47-40 percent margin, and he’s pulled even with Obama (47-47 percent) as to who is the stronger leader. Romney also is favored to be more successful in reducing the federal budget deficit (51-36 percent), improving the job situation (49-41 percent), and in handling tax policy (47-43 percent). The president is still perceived as the better person to handle Medicare (51-38 percent), health care (47-44 percent, though that margin swung a net 10 points in Romney’s favor since their Sept. 12-16 poll), and in making wise foreign policy decisions (47-43 percent).

The next presidential debates, scheduled for Oct. 16 and 22 will take on a whole new aura and meaning, after what happened in the first meeting. If Romney has accomplished anything, he has put national debating on center stage.

A Quintet of Close New House Polls

Now that we’ve passed Labor Day, congressional polls are going to be released at a fast and furious pace. Yesterday several surveys came into the public domain, each revealing close races for the tested subjects. Some of the new data appears surprising, but considering the redistricting or political situation surrounding the incumbent such results should have been expected.

Around the horn, close races are confirmed for Reps. Mary Bono Mack (R-CA-36), Mike Coffman (R-CO-6), Bill Johnson (R-OH-6), David Rivera (R-FL-26) and the open WA-1 campaign between Republican John Koster and Democrat Suzan DelBene.

Polling for the liberal advocacy group Democracy for America, Public Policy Polling (Sept. 12-13; 1,281 likely CA-36 voters via automated interviews) gives California Rep. Bono Mack only a 47-44 percent lead over physician Raul Ruiz (D). The Riverside County district favors Republicans in registration by a 40.3 to 38.6 percent margin and the PPP sampling universe showed a 41-40 percent Republican to Democrat ratio. Therefore, the poll accurately reflects the desert district’s political division. This is the second poll that has projected the campaign to be within the margin of error. Such is not a surprise because this district can be competitive and Dr. Ruiz is proving to be a formidable opponent.

In Colorado, when the court re-drew the 2011 congressional map, the incumbent receiving the most adverse district was sophomore Rep. Mike Coffman. His 6th District went from 53-46 percent McCain to a 54-45 percent Obama, a net swing of 16 points toward the Democrats. So, it’s no surprise that he would be in a tough 2012 campaign. The Democratic Congressional Campaign Committee released another of their methodologically questionable interactive voice response polls, this one of only 350 people. The results show Coffman leading 42-39 percent, which on this type of survey, and being unaware of the types of questions asked, may not be a bad result for the Republican incumbent. The new confines of the district will yield a close race, but it is reasonable to conclude that the DCCC three-point Republican advantage conclusion most likely understates Rep. Coffman’s true support.

The 6th District in Ohio is a Democratic-leaning district at the very least. Freshman Rep. Bill Johnson’s upset of two-term Rep. Charlie Wilson (D) was one of the biggest surprises of the 2010 cycle. Therefore, it was expected that the re-match would be close. According to an Anzalone-Liszt survey for the Wilson campaign (Sept. 9-12; 500 likely OH-6 voters), the results confirm such a prediction. The Democratic internal data projects the race to be a 46-46 percent tie. Both candidates are accusing the other of voting to cut Medicare. The 6th, Ohio’s largest coal-producing district, could well vote based upon energy policy. The Cap & Trade issue was a major reason for Johnson’s 2010 win, even though Wilson had opposed the bill when he was in the House. This race appears to be a pure toss-up.

In Florida, Public Policy Polling, again for Democracy for America (dates and sample size not released) fielded a survey that was basically in the push-poll category as it asked several questions regarding the FBI investigating freshman Rep. David Rivera (R-FL-26). The pre-push result showed two-time former congressional nominee Joe Garcia (D) leading the first-term representative 46-39 percent. After the push questions were asked and recorded, the secondary ballot test gave Garcia a 49-36 percent lead. There is no doubt that Rivera has political problems, and since the new 26th CD is politically marginal the six point Democratic lead is certainly within the realm of possibility.

Finally, in Washington state, a Survey USA poll (Sept. 13-15; 593 likely WA-1 voters) gives Republican John Koster a 46-42 percent lead over Democrat Suzan DelBene. Both individuals are former congressional nominees. The new 1st is much different from the current CD-1 that Democratic gubernatorial nominee Jay Inslee formerly represented. Fifty-two percent of the territory is new to the 1st District, but it’s an area largely comprised of places Koster represented during his tenure in the legislature and on the Snohomish County Commission. While 56 percent of the CD-1 voters supported President Obama in 2008, such a number represents a swing of 12 points toward the Republicans from WA-1’s former configuration. The S-USA poll shows Koster trailing DelBene by just one point among female voters, which is likely to expand in DelBene’s favor as the campaign continues toward Election Day. This race is expected to be close, but in a presidential year, the Democrats should command at least a slight edge.

With Ryan, the Battle Lines are Drawn

Mitt Romney’s selection of House Budget Committee Chairman Paul Ryan (R-WI-1) as his vice-presidential nominee has drawn clear battle lines for the remainder of the presidential election campaign. With Ryan being best known for the “Ryan Budget” that passed the House last year and his attempts to restructure the federal budget platform, including entitlement programs, both sides will now focus on the country’s long-term economic direction and try to accuse the other of “destroying Medicare.” President Obama and the Democrats will continue their claim that the Ryan Budget ends Medicare “as we know it.” Republicans will counter that Obama and his congressional allies, by introducing and passing the Affordable Healthcare Act, voted to cut over $500 billion in the Medicare program. One thing is now certain: the voters will have a clear ideological choice to make in November.

Questions have arisen as to what now happens to Ryan’s congressional seat, since he is on the ballot today for renomination. Since Wisconsin law is silent on the subject of running nationally and simultaneously for Congress, and because there is no mechanism for removing a person from the Badger State ballot once they are nominated, Ryan’s name will appear for both the vice presidency and the 1st Congressional District. Should he win both elections, then the 1st CD would go to special election in early 2013 upon the congressman’s official resignation from the House.

Ben Nelson’s “Independent” Ad

A year away from the 2012 election, embattled Nebraska Sen. Ben Nelson (D) already has embarked on a rather interesting strategic course. If the logic behind his new television ad ultimately prevails, a new chapter in campaign finance law could be opening. If the Republicans directly counter-attack, Nelson may have prematurely opened a door that he would have preferred kept closed.

The Nebraska Democratic State Central Committee is paying for an ad that attacks all three of Nelson’s Republican opponents, graphically portraying them as three peas in a pod. The Senator’s campaign claims that this ad is part of an independent issue expenditure and should not count against the coordinated expenditure limit between party and candidate. What’s different about this “independent” ad – one that cannot be coordinated with a campaign – is that the senator himself appears in the spot and says he approves of its message. If this is considered “independent,” then we could have a whole new approach to all other independent expenditure campaigns.

In the body of the ad, Nelson and his party claim the Republican candidates want to cut Medicare and Social Security and that he (Nelson) will protect them both. Yet, when the senator became the deciding vote on the Obama healthcare plan that led to the infamous “Cornhusker Kick-back” attack, now the source of Nelson’s current political trouble, he himself supported a $500 million cut in Medicare by voting for the bill. The counter-argument to this point seems an easy one for the GOP candidates to make.

The new party ad, independent or not, may prove to cause Sen. Nelson more trouble than it might be worth. His taking such bold action at this time clearly confirms the public polls that show him trailing his Republican opponents.

Democrats Convert Seat in New York’s 26th

Democratic/Working Families Party nominee Kathy Hochul, who began as little more than a sacrificial lamb in what should be a relatively safe Republican district, won the special election last night to succeed former Rep. Christopher Lee (R). Mr. Lee resigned the seat earlier in the year to avoid publicizing an impending personal scandal. Ms. Hochul, the Erie County clerk, defeated state Assemblywoman Jane Corwin who held the Republican, Conservative and Independence Party ballot lines, along with Independent Jack Davis. Hochul’s margin was 47-43-9% against Corwin and Davis, respectively.

Turnout appeared to be low, especially in comparison to the previous upstate specials that broke 35 percent in voter participation. Approximately 115,000 people cast ballots, not counting what are likely several thousand yet-to-be-tabulated absentee votes. The turnout rate was hovering around 28 percent.

The two most recent pollsters called the race accurately. The closing surveys, one from Siena College and the other Public Policy Polling, showed Hochul holding four- and six-point leads, respectively, during the weekend directly preceding the election. The final margin, as revealed above, was four points.

The result allows the Democrats to extend their strong performances in special elections and adds to the commensurate Republican woes, particularly in multi-candidate upstate New York contests. The Hochul victory represents the third such favorable Democratic result in the last four New York special elections, even though the Republicans were favored at the beginning of each race.

The focal point of the campaign became Independent Jack Davis who labeled himself with the word “Tea.” New York election law allows qualifying Independents to describe themselves in a similar manner to party designation labels for the major candidates. Davis, however, was not a Tea Party member. He previously ran for Congress three times as a liberal Democrat. The Davis candidacy sparked confusion and controversy, thus causing Republican nominee Corwin to make unforced errors that ultimately cost her the seat. At one point, Davis was polling within just a few points of Hochul and Corwin, topping out at 23 percent. Then, both the Democrats and Republicans unloaded on Davis, ultimately costing him two-thirds of his potential support.

Aligned with the Conservative and Independence parties in a seat drawn for the GOP, this special election should have gone the Republicans’ way. Again, as had been the case in what proved to be a disastrous 23rd district contest (Rep. Bill Owens) two different times for Republicans, a minor party candidate cut against the GOP nominee and cost them the seat.

Total spending among the contenders broke $7 million, but the three candidates themselves contributed over $5 million of that total. Davis is a multi-millionaire who has traditionally self-funded his campaigns. He spent more than $2.6 million for this special election. Corwin dumped a similar amount into her campaign.

Outside entity spending was interesting. According to the latest OpenSecrets.org analysis, $1.99 million, in addition to the candidates’ cumulative total, was injected by independent organizations. A great deal of those expenditures, better than $755,000 worth, were targeted in opposition to Davis. More than $541,000 went against Hochul, and an additional $471,000 targeted Corwin. Both major party candidates also received positive independent expenditures, but those totaled less than $150,000 apiece.

The count in the House is now 241 Republicans and 193 Democrats with one vacancy. The open California 36th district will be filled on July 12th. Democrat Janice Hahn is a heavy favorite in that campaign. The New York delegation will now head into redistricting, where the state loses two seats in reapportionment, with 22 Democrats and seven Republicans.

Democrats will attempt to frame this election as a referendum on Medicare, as they continually attacked Corwin for saying she would support the controversial Ryan budget plan. The Republican never effectively countered the attack. The bigger issue, however, was the repeated Corwin mistakes that once again allowed a New York Republican seat to slip through the GOP’s fingers. In a special election, when turnout is always down and sometimes not reflective of a district’s voting patterns, the candidate running the more competent campaign generally wins. Clearly, Ms. Hochul was the superior campaigner in NY-26 during this battle.
